DEVELOPMENT OF THE INSTITUTION OF REVIEW OF A JUDICIAL ACT ON NEWLY DISCOVERED AND NEW CIRCUMSTANCES IN CIVIL PROCEEDINGS OF THE REPUBLIC OF ARMENIA

Abstract: The article is dedicated to the historical and legal analysis of the institute of review of judicial acts that have recently emerged in civil proceedings in Armenia and entered into legal force based on new circumstances. The author traces the development of this institution, starting from the oldest legal sources, such as the Code of Hammurabi, to the modern legislation of the Republic of Armenia, including the Civil Procedure Codes of 1964, 1998, and 2018. The work pays special attention to the peculiarities of legal regulation in different historical periods, borrowings from foreign legal systems, in particular from French, as well as the influence of international law, including the European Convention on Human Rights. A conclusion is drawn about the importance of the institution of judicial review as an effective mechanism for protecting violated civil rights, the need for its preservation and improvement, taking into account existing theoretical and practical problems.
