THE CONTRACT FOR THE PROVISION OF TOURISM SERVICES AS A CIVIL CONTRACT AND CERTAIN FEATURES OF ITS SUBJECT MATTER

Abstract. The article examines the legal nature of the contract for the provision of tourist services and issues related to its subject matter. Analysis of the legal qualification of the package travel contract under the RA Law “On Tourism” reveals inconsistencies between the objects of contractual obligations in the Civil Code of the RA and the sectoral law, showing that a package travel, as an object of civil rights, constitutes a set of services. Consequently, conclusions about its proprietary nature and the use of terms such as “realization” and “sale” regarding the statutory object are unjustified. The analysis also indicates that the subject matter of the contract includes not only tourist services provided by tourism activity entities themselves but also the organization of consumer travel within a package or tour composed of services from third parties, or the organization of individual tourist services. Therefore, the article proposes a comprehensive definition of the contract, applicable to the full range of services provided to consumers.
