CRIMINAL AND LEGAL CHARACTERISTICS OF STALKING

Abstract. The article is devoted to a comprehensive analysis of the criminal and legal characteristics of the offense of stalking as prescribed in Article 196.1 of the Criminal Code of the Republic of Armenia.
The author examines the objective and subjective elements of the corpus delicti of stalking and interprets specific terms employed by the legislator.
Particular attention is paid to the issues concerning the legal qualification of stalking in conjunction with other offenses, and the aggravating circumstances of stalking are clarified. Based on the research findings, the author puts forward a legislative proposal, as well as presents his own positions on certain issues related to the legal qualification of stalking.
