LEGAL ASSISTANCE OR REPRESENTATION FEES IN ADMINISTRATIVE PROCEEDINGS OUTSIDE THE SCOPE OF ADMINISTRATIVE COSTS

Abstract. The content and the meaning of the concept of "administrative expenses" in accordance with the legislation of the Republic of Armenia are discussed in the article. It illustrates whether payments for legal representation or assistance of participants in administrative proceedings can be included in administrative expenses, as well as the possibility of reimbursement of such costs. A comparative analysis of legal acts regulating similar relations in the Republic of Armenia and foreign countries is conducted, highlighting some positive solutions and identifying effective approaches to regulating these legal relations.
The position of the RA Administrative Court regarding the framework and procedure for reimbursement of administrative expenses is considered, demonstrating that the judicial practice formed on the specified issues, in our opinion, is not always uniform and effective.
As a result of the research, the author concludes that administrative expenses and fees for representation or legal assistance of a participant in administrative proceedings are on different grounds, as well as confirms the absence of possibility of reimbursement of these costs in administrative proceedings.
